By creating an account, accessing, or using The Masterbook at themasterbook.live (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms form a binding legal agreement between you and the operator of The Masterbook, based in Sydney, New South Wales, Australia. We may update these Terms from time to time with 14 days' notice. Continued use after the effective date constitutes acceptance.
The Masterbook is a trading journal and performance analysis platform that enables users to log and review trades, track psychology and discipline, use risk management calculators, and generate AI-powered performance coaching based on their own journal data.
The Service is an educational and journalling tool only. It is not a financial product, financial service, or investment advisory service. Nothing in the Service constitutes financial advice, investment advice, or any regulated activity. See Section 9 for the full financial disclaimer.
You must be at least 18 years old to use the Service. By creating an account, you represent that you are at least 18, have the legal capacity to enter into this agreement, and that your use of the Service complies with all laws applicable to you.
You must register with a valid email address and agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your credentials and must not share your account with any other person. You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorised use at legal@themasterbook.live.
Access to full features requires an active paid subscription. Subscriptions are billed monthly and renew automatically on the same date each month unless cancelled beforehand. All payments are processed securely by Stripe. We do not store your card number, CVV, or full payment details. If a payment fails, access to the Service may be suspended. We reserve the right to change pricing with 30 days' notice.
You may cancel your subscription at any time through your account settings or by emailing legal@themasterbook.live. Upon cancellation, your subscription remains active until the end of the current billing period. You will not be charged for the following period. Following cancellation, your account data is retained for 30 days, during which you may export your journal. After 30 days, your data is permanently deleted.
All subscription fees are non-refundable except as required by applicable law (including Australian Consumer Law). New subscribers receive a 3-day free trial. You will not be charged during the trial period and your payment method will be charged at the start of the first paid period unless you cancel before the trial ends. No charge until day 4.
If you believe you are entitled to a refund under applicable consumer protection law, contact legal@themasterbook.live. For Australian users: nothing in this section limits your rights under the Australian Consumer Law.

Violation of this section may result in immediate termination of your account without notice or refund.
Not Financial Advice. The Masterbook is a personal trading journal and performance analysis tool designed solely for educational and record-keeping purposes. Nothing in the Service — including journal analytics, AI coaching responses, risk calculations, prop firm information, trade summaries, or market commentary — constitutes financial advice, investment advice, securities advice, a recommendation or solicitation to buy, sell, or hold any financial instrument, or any regulated financial activity.
Not a Regulated Activity. We are not a licensed financial adviser, stockbroker, investment manager, or regulated entity under the Corporations Act 2001 (Cth), the Financial Services and Markets Act 2000 (UK), MiFID II, or any other financial services legislation. We do not hold an Australian Financial Services Licence (AFSL) or any equivalent licence.
AI Coaching. The AI coaching feature analyses the data you enter in your journal and provides generalised performance feedback based on patterns in your own data. It is not personalised financial advice, it is not provided by a licensed financial adviser, and it does not consider your full financial situation, objectives, or risk tolerance.
Your Responsibility. All trading and investment decisions are made solely by you at your own risk. Trading financial markets involves substantial risk of loss. Past performance recorded in your journal is not indicative of future results. You are solely responsible for all trading decisions and outcomes. We strongly recommend seeking the services of a licensed financial adviser before making any trading or investment decision.
Prop Firm Information. Information about proprietary trading firms is provided for general convenience only, may not reflect current terms, and we are not affiliated with or responsible for any firm referenced in the Service.
All software, design, text, graphics, trademarks, and other content comprising the Service are owned by or licensed to us and are protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial purposes during your subscription period. This licence does not permit copying, reproduction, distribution, or commercial exploitation of any part of the Service.
Your journal entries, trade notes, and other content you create remain your property. You may export and delete your data at any time.
The Service is provided "as is" and "as available." We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
We are not liable for any trading losses, financial losses, or investment losses arising from your use of the Service or reliance on any information in the Service.
To the maximum extent permitted by law, our total aggregate liability for any claim shall not exceed the total subscription fees you paid in the three months immediately preceding the event giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profit or data.
For Australian users: nothing in this section excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law that cannot be excluded by contract.
We reserve the right to suspend or terminate your account at any time if you breach these Terms, if required by law, or if your use poses a risk to us or other users. You may terminate your account at any time by cancelling your subscription and requesting deletion at legal@themasterbook.live. Sections 9, 10, 11, 13, and 14 survive termination.
These Terms are governed by the laws of New South Wales, Australia. You agree to the exclusive jurisdiction of the courts of New South Wales for any dispute. Before commencing formal proceedings, contact us at legal@themasterbook.live to attempt informal resolution within 30 days.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service. If any provision is found invalid or unenforceable, it will be modified to the minimum extent necessary. Our failure to enforce any provision is not a waiver. You may not assign your rights under these Terms.
